4. Notice of infringement (17 U.S.C. § 512(c)(3))

A notice must be sent in writing to the Agent and include:

(1) a physical or electronic signature of the copyright owner or a person authorised to act on its behalf;

(2) identification of the copyrighted work claimed to be infringed (or, for multiple works, a representative list);

(3) identification of the material claimed to be infringing and to be removed, with information reasonably sufficient to locate it (URL);

(4) your name, postal address, telephone number and e-mail address;

(5) a statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent or the law;

(6) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on its behalf.

If a notice is incomplete, we will tell you what information to add.

5. Our response

Upon receipt of a compliant notice we expeditiously remove or disable access to the material and notify the person who posted it, if we have their contact details.

6. Counter-notification (17 U.S.C. § 512(g))

If you believe your material was removed by mistake, send the Agent a counter-notification including:

(1) your physical or electronic signature;

(2) identification of the material removed and the location at which it appeared before removal;

(3) a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification;

(4) your name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which the publisher may be found), and that you will accept service of process from the person who provided the notice or that person’s agent.

Upon receipt of a compliant counter-notification we promptly forward a copy to the complainant and inform them that we will restore the material in 10 business days. The material is restored no less than 10 and no more than 14 business days after receipt of the counter-notification, unless the Agent first receives notice from the complainant that it has filed an action seeking a court order to restrain the posting of the material.

7. Misrepresentations

Any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, is liable for damages, including costs and attorneys’ fees (17 U.S.C. § 512(f)).

8. Repeat infringers (17 U.S.C. § 512(i)(1)(A))

We restrict and, in appropriate circumstances, terminate the ability to post comments and submit material for persons who are the subject of repeated valid notices of copyright infringement. Two valid notices within 12 months that are not rebutted by a counter-notification constitute grounds for termination.

9. Scope

The procedures of §§ 512(c) and 512(g) apply to material posted by users. Complaints about the magazine’s editorial content are handled at the same address within 10 business days.
